This work is in the public domain in Algeria and the US according to the Order No. 73-14 of April 3, 1973 corresponding to copyright (in fr) (PDF), which had copyright terms of 25 years except for photographs. Although it was repealed by Order No. 97-10 dated 27 Shawwal 1417 corresponding to March 6, 1997 related to Copyrights and Neighboring Rights (in fr) (PDF) and Ordinance No. 03-05 of 19 July 2003 (in fr) (PDF)., Article 160 of the 1997 law and Article 161 of the 2003 (current) law specify non-retroactivity of the protection terms for works that already fell into public domain. Thus, this Algerian work is in the public domain in both Algeria and the US because it meets one of the following criteria: it is an anonymous, pseudonymous, cinematographic, posthumous or collective work published before 1972 it is a photograph or work of applied art published before 1987 or created before 1948 it is another type of work and its author (or last-surviving author) died before 1972 Note The copyright of all Algerian photographs and works of applied art published prior to 1948 had expired in Algeria on the date of restoration (April 19, 1998) pursuant to the provisions of Article 60 (in fr) (PDF) of the defunct Ordinance No. 97-10 of 6 March 1997 (in fr) (PDF) which was in effect at the time. Such works are thus currently in the public domain in the United States. This work is in the public domain in the United States because it meets three requirements: it was first published outside the United States (and not published in the U.S. within 30 days), it was first published before 1 March 1989 without copyright notice or before 1964 without copyright renewal or before the source country established copyright relations with the United States, it was in the public domain in its home country (Algeria) on the URAA date (19 April 1998).
